COURT DISMISSES KUSI BOATENG’S CONTEMPT APPLICATION AGAINST ABLAKWA

The Accra High Court has thrown out contempt charges brought against the Member of Parliament of North Tongu, Samuel Okudzeto Ablakwa, brought by the Secretary to the Board of Trustees of the National Cathedral, Rev. Victor KUSI Boateng.
Lawyers of Rev. Victor Kusi Boateng filed contempt charges after the MP for North Tongu was sighted in a video refusing to be served with court summons relating to a defamation suit brought against him. In the video, he is seen kicking the documents with his foot in the process.
Kusi Boateng sued the Member of Parliament for a publication claiming that he is engaged in a conflict of interest and double identity for allegedly operating under another name, Kwabena Adu Gyamfi.
However, yesterday (2nd May, 2023), the court dismissed the contempt charges on the grounds that the baliff was not a certified staff of the Judicial Service.
Justice Charles Gyamfi Dabkwah dismissed the case while Rev. Victor Kusi Boateng was slapped with a fine of GH¢10,000.00.
Justice Dabkwah added that, in 2021 the Chief Justice directed that writs should only be served by members of the Judicial Service.
But the court noted that the alleged bailiff is not a staff of the Judicial Service so the process cannot be legitimate.
The case was dismissed on the grounds that the alleged bailiff did not follow due process in serving the defendant in February 2023.
